Supreme Court has cleared the way for reaching a final word on the Ayodhya dispute case on Thursday as well. A 3-judge bench headed by the chief justice, who is set to retire on the 2nd of October, declined to set up a larger bench for a relook of its 1994 observation which said a mosque is not an essential part of the practice of Islam. A 2:1 majority ruling said that question is not relevant to Ayodhya's title dispute. The Supreme Court has refused to send the question of whether a mosque is an integral part of Islam or not, to a larger Bench for its consideration.

The question relates to its observations made in a 1994 verdict.The issue was raised during an appeals hearing of the Ayodhya land dispute case. In a 2:1 majority ruling, the apex court bench headed by Chief Justice Deepak Mishra said. The civil suit has to be decided on the basis of evidence, and the previous verdict has no relevance on this issue.

The majority view said it has to find out the context in which the five-judges had delivered the 1994 judgement, but that verdict has no relevance to this case. In 1994, in a case related to land acquisition in and around the Babri Masjid, the Supreme Court had observed that a mosque was not an essential part of the practice of Islam and namaz could be offered anywhere, even in the open.

On Thursday, dissenting Judge Justice Abdul Nazir said a decision on whether a Mosque is an integral part of Islam requires deeper consideration keeping in mind religious beliefs. The apex court said the hearing on the land dispute will begin with a new bench on October 29.

Chief Justice Dipak Mishra is retiring on October 2. The decision has by and large been welcomed across the board.

The Rashtriya Swayamsevak Sangh has welcomed the decision and hoped that a final verdict in the dispute will be reached soon.

The three-judge bench headed by Chief Justice Dipak Misra was hearing petitions challenging the 2010 Allahabad High Court verdict in the Ayodhya case.The Allahabad High Court had divided the land into three parts, and all parties had then approached the Supreme Court in appeal.This appeal of all the parties, will now be heard on October 29.(Updated on September 27th 2018)
